HR 2189 is the House bill that incorporates a look-back period of 36 months in Veterans pension benefits planning, and penalties for uncompensated transfers. The bill passed the House on October 28, 2013, and is making its way to the Senate for consideration. Within HR 2189, it was provided that: “the Secretary may consider…a transfer of an asset (including a transfer of an asset to an annuity…) a disposal of a covered resource for less than fair market value if such transfer reduces the amount in the corpus of…the estates of the veteran and of the veteran’s spouse, that the Secretary considers, under all the circumstances, would be reasonable to be consumed for the veteran’s maintenance.” - Vietnam Veterans Memorial Wall
